E-BIKE RENTAL CONTRACT AND WAIVER OF LIABILITY AGREEMENTACKNOWLEDGMENT AND ASSUMPTION OF RISK AND RELEASE INDEMNIFICATION AGREEMENT

Please review this document carefully. By engaging in payment transactions, whether by direct payment, electronic methods, ticking a checkbox, providing a signature or an electronic signature, you acknowledge that you have comprehensively read, comprehended, and consented to the stipulations of this Agreement. You are consequently legally bound by it. The participant, for themselves, their successors, executors, administrators, and assignees, agrees as follows with Coastal E-Bikes:

I acknowledge that engaging in e-bike activities or employing related equipment encompasses inherent dangers that may lead to bodily harm, psychological trauma, paralysis, death, or damage to myself, my property, or to others. These risks are inherent to the activity and cannot be eradicated by Coastal E-Bikes without compromising the fundamental characteristics of the activity. I accept it is my duty to adhere to road safety regulations applicable in Florida. I am aware that riders below the age of 16 are mandated to wear helmets and that riding during nighttime requires proper front and rear lighting corresponding to Florida’s road safety legislation. I consciously choose to accept all risks associated with e-bike usage.

I hereby exonerate Coastal E-Bikes from any accountability for injuries or damages sustained by myself or others using the rented/leased equipment under this agreement.

I willingly accept all hazards inherent in e-bike activities. My participation is deliberate, and I choose to proceed despite these risks.

Furthermore, I agree to defend, indemnify, and hold harmless Coastal E-Bikes against any claims, losses, liabilities, and expenses—including legal fees—stemming from my engagement in these activities or use of rented/leased equipment.

I certify that I possess adequate insurance coverage for any potential injuries or damages incurred during this activity or that I will personally bear the costs. Any insurance I maintain shall serve as primary coverage in the event of an incident.

I certify that I am medically and physically capable of participating in this activity without risking my safety or I accept any consequences of existing conditions.

The equipment remains the exclusive property of Coastal E-Bikes at all times. I understand that I am liable for any damage or loss of equipment and agree to compensate Coastal E-Bikes for its value should it be deemed irreparable.

Should Coastal E-Bikes incur any costs, including attorney’s fees, to enforce this agreement, I agree to indemnify them for all such expenses.

I waive any right to a jury trial regarding litigation related to or arising from this agreement. This clause is a significant factor in our mutual decision to enter into this agreement.

All claims or disputes arising from this agreement shall be governed by Florida law, and Bay County Court holds exclusive jurisdiction over such matters.

I knowingly assume all liability associated with the operation and possession of the rental property.

By confirming acceptance electronically or via signature on this agreement, I affirm that I am fully competent to enter into this contract; understand its terms; recognize that I am legally bound by it; and willingly assume all liability for possession and operation of the rental property.

E-BIKE RENTAL TERMS PARTICIPATION

The participant agrees to adhere to all terms set forth herein regarding the use of Coastal E-Bikes equipment.

Authorized Use/Restrictions on Passengers (E-Bike Rentals)

  • The equipment must be operated solely by the participant unless the rented model is designated to accommodate more than one person.
  • Modifications to the equipment to add passenger capacity are not permitted, except for models like the Paker 1 E-Bike which are designed for such use.
  • Towing of objects is permitted only if a compatible pull-behind accessory is rented together with the E-Bike and must be used in accordance with manufacturer guidelines.

Group Rentals (Single Payor)

  • Single payors must inform their group of this waiver; failure to do so results in indemnification of Coastal E-Bikes against claims from uninformed group members.

Return of Equipment

  • Equipment must be returned on time and in the same condition as received, barring normal wear and tear.

Repossession

  • Coastal E-Bikes reserves the right to repossess the equipment under specified conditions without prior notice.

Prohibited Use

  • There are geographic and usage restrictions. Violating these terms terminates the rental immediately and subjects the participant to penalties and legal expenses related to such violation.

Damage to Equipment/Bicycles

  • The participant is liable for any damage or loss of equipment regardless of fault and agrees to pay for repairs, replacement, loss of use, administrative fees, towing, pick-up, and/or storage charges as applicable.

Accidents

  • The participant’s insurance is considered primary coverage for accidents involving Coastal E-Bikes equipment.

Third Party Claims

  • The participant is responsible for third-party injury or damage claims and must indemnify Coastal E-Bikes for such claims.

Assumption of Risk

  • The participant voluntarily assumes all risks associated with operating the equipment and agrees to hold Coastal E-Bikes harmless from all claims of injury or damage.

Disclaimer of Warranties

  • Rental equipment is provided “as-is” without warranties. Coastal E-Bikes is not responsible for enforcing manufacturer warranties on behalf of participants.

Electric Bicycle Rentals

  • Additional terms are specified for electric bikes, including age restrictions, operational boundaries, and consequences for failure to return electric bikes or their charging devices.

Payment

  • The participant agrees to pay all applicable charges, repair costs, and other fees as outlined in the agreement and authorizes Coastal E-Bikes to bill these to the participant’s chosen payment method.

Credit Reserve and Payment

  • A deposit equal to the estimated rental charge is required, and Coastal E-Bikes may charge any due amounts to the participant’s credit card.

Marketing

  • The participant grants Coastal E-Bikes the right to use their likeness for advertising and promotions, with the option to discuss removal or discontinuation.

General Provisions

  • The participant confirms the accuracy of their information and understands that unauthorized repairs or modifications are not covered by Coastal E-Bikes. Any misrepresentation may result in the termination of this agreement and the reimbursement for the full cost of the rented equipment.
